1.Terms

By accessing and using Power Living Australia's Teacher Training programs, you expressly agree to be bound by the following terms and conditions. If you do not agree with any part of these terms, you are prohibited from accessing or using this site.

The materials and content within the Power Living Teacher Training Programs are protected by applicable copyright and trademark laws.

2.Intellectual Property

All Intellectual Property Rights pertaining to the course materials, online courses, and verbal presentations by trainers at in-person courses remain the exclusive property of Power Living Australia Pty Ltd, whether they are adapted, authored for, or customised for individual clients.

You are expressly prohibited from:

  • Copying, modifying, reproducing, re-publishing, sublicensing, selling, uploading, broadcasting, posting, transmitting, or distributing any course materials without prior written consent.
  • Recording, whether in video or audio format, or relaying through any means, the online course or in-person course sessions.
  • Utilising the course materials in the development or delivery of any other course or training program, whether conducted by Power Living or any third-party trainer.
  • Removing any copyright or proprietary notices associated with Power Living Australia Pty Ltd from the course materials.
  • Altering, adapting, merging, translating, disassembling, decompiling, or reverse engineering any software forming part of the online courses, except to the extent permitted by law.

Violation of these provisions may result in termination of the terms and cessation of services, including access to online courses, while Power Living reserves the right to seek legal remedies.

In consideration of the fees paid, including where applicable $0 fees, Power Living grants a limited, non-transferable, non-exclusive licence to use the course materials and associated software exclusively for completing the online course and/or attending in-person courses.

3.User Licence

Students are granted permission to access and download one copy of all downloadable materials on the Power Living Education site for each Teacher Training Program in which they are enrolled.

The materials are provided for personal, non-commercial and temporary viewing. This is a licence, not a transfer of ownership.

Students may not:

  • Modify or duplicate the materials.
  • Use the materials for any commercial purpose, whether for profit or non-profit, or for any public display.
  • Attempt to decompile or reverse engineer software embedded within the School's website.
  • Share login details or any component of the content with another individual.
  • Remove copyright or proprietary notices.
  • Transfer the materials to another individual or duplicate them on another server.

The licence automatically terminates if these restrictions are violated and may be revoked by Power Living Australia Pty Ltd at its sole discretion without prior notice.

4.Disclaimer

The materials provided within the Power Living Education site and all training programs hosted there are presented "as is." Power Living Australia Pty Ltd makes no express or implied warranties and disclaims warranties relating to:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement of intellectual property or other rights

Power Living also does not warrant or represent the accuracy, likely outcomes or dependability of using the materials on its website, materials connected to the website, or linked websites.

5.Limitations

Power Living Australia Pty Ltd will not be held liable for damages including loss of data, loss of profit or business interruption arising from the use or inability to use materials relating to the Power Living Online Teacher Training Program, even if Power Living or a member of its team has been advised of the possibility of such damage.

Certain jurisdictions may not permit limitations on implied warranties or consequential/incidental damages, so these limitations may not apply in every jurisdiction.

6.Revisions and Errata

Materials on Power Living's Education site may contain technical, typographical or photographic errors.

Power Living does not guarantee that materials are accurate, complete or current.

Power Living Australia Pty Ltd reserves the right to modify website materials at any time without prior notice, but does not undertake to revise them.

7.Links

Power Living Australia Pty Ltd has not reviewed all websites linked to its website and accepts no responsibility for their contents.

Including a link does not imply endorsement by Power Living.

Use of linked websites is entirely at the user's own risk.

8.Site Terms of Use Modifications

Power Living Australia Pty Ltd reserves the right to amend its website Terms of Use at any time without notice.

By using the website, users agree to be bound by the current version of the Terms of Use.

9.Governing Law

Any dispute arising in connection with Power Living's Online Teacher Training Program will be governed by the laws of Australia, without regard to conflict-of-law provisions.

10.Payment Policy

Payment terms are specified within each individual program.

Full payment, including all payments under a payment plan, must be made before a training certificate is issued.

11.Withdrawal

If a student wishes to withdraw from a training program after receiving their manual and/or commencing coursework, they must provide written notice to Power Living Australia Pty Ltd.

The applicable refund policy is outlined below.

12.Refund Policy

Power Living Australia Pty Ltd offers a full course refund for any reason when a student withdraws more than 8 weeks before the course start date.

There are no refunds for change of mind.

However, if a student needs to withdraw due to personal circumstances preventing course completion, such as a medical emergency, prolonged illness, death in the family or another exceptional situation, the following options apply:

Withdrawal 4–8 weeks before the course start date

  • Fees paid will be refunded.
  • A $200 administration fee will be deducted.

Withdrawal within 4 weeks of the course start date

  • Course fees are non-refundable.
  • The student may instead choose to transfer and/or defer their enrolment for up to 12 months.

Re-enrolment Following Withdrawal

If a student withdraws and later chooses to re-enrol:

Within 6 months of the initial purchase date

  • Previous course progress will be reinstated.
  • Previously paid monies will be applied towards the same course.
  • No additional administration fee applies.

More than 6 months after the initial purchase date

  • All previous payments are forfeited.
  • The student must pay the full course fee again.
  • Previous course progress will not be reinstated.

13.Transfer Policy

Students wishing to transfer to another course must submit a written transfer request.

Transfers are not guaranteed and are assessed case-by-case, subject to course availability.

30 days or more before course commencement

  • Transfer is permitted.
  • All payments already made will be applied to the new course.

29 days or less before course commencement

  • The non-refundable $200 deposit is forfeited.
  • All other payments already made will be applied to the new course.

After course commencement

All fees paid become non-transferable.

If the new course costs more

The student must pay the difference according to the revised payment terms.

If the new course costs less

No refund will be provided for the difference.

Any bank or transaction fees associated with the transfer are the student's responsibility.

14.Failed Payments

If a monthly payment under a payment plan fails, the student has a 14-day grace period to rectify the outstanding payment.

If payment is not brought up to date within this period:

  • The student will be unenrolled from the course.
  • No refunds will be provided.
  • Power Living will attempt to contact the student.
  • Failure to respond will be treated as withdrawal.
  • A certificate will not be issued until all payments have been settled.

15.Course Extension

Online Training course materials can be accessed for 12 months.

The course must be completed within that period for certification.

If the student has not completed the course and has not requested a deferral due to extenuating circumstances, they may request one six-month extension.

16.Course Completion and Assessment

To receive certification, students must:

  • Complete 100% of the course content.
  • Submit all assessments.
  • Accurately log required hours.

The course is competency-based, meaning there is no pass or fail.

Students may resubmit their final assessment until they are deemed competent, up to a maximum of 12 months from their course enrolment date.

17.Reassessment

If an assessment is deemed not competent, Power Living will provide feedback and suggest areas for revision.

Reassessments must be completed within 12 months of the enrolment date.

18.Venue Changes

Power Living Australia Pty Ltd reserves the right to change the training venue if necessary.

If the location changes, Power Living will make arrangements to ensure transportation to the alternative venue.

19.Cancellations

Power Living Australia Pty Ltd reserves the right to cancel retreats, training sessions and programs at any time and for any reason.

If Power Living cancels, its liability is limited to a full refund of the money received from the student or on their behalf.
